Arra a politikai terrorra, amelyet a Tanácsköztársaság idején vezettek be Magyarországon a kommunisták, nem volt felkészülve az ország. De a magyar jogrend sem volt felkészülve a kommün bukása után a büntetésekre. Egyszerűen nem voltak jogszabályok az ilyen működésre, mert előtte annyira elképzelhetetlennek tűnt az állam terrorja.
