About this episode

The episode discusses the complexities of a jury deadlock in the Lindsay Clancy case and the implications for the jury system.

After more than thirty-five hours of deliberations, Lindsay Clancy’s jury faced something more complicated than disagreement. Her attorney says the foreperson told Judge William Sullivan that one juror was not applying the court’s reasonable-doubt instruction. The defense asked Sullivan to remove that juror. He declined. That decision puts the jury system itself under the microscope. A juror cannot be removed simply because eleven people dislike the twelfth person’s conclusion. That would destroy the entire purpose of unanimity. But what if the dispute is genuinely about refusing to follow the law? Then add dueling psychiatric experts, emotionally devastating evidence and six days of confinement with the same eleven people. Tony Brueski examines where legitimate dissent ends, where obstruction begins, and whether the pressure to produce a verdict can eventually become part of the problem.
