The episode discusses the shift of Biglaw firms into plaintiff-side litigation and features a panel of experts on the topic.
For much of the time that I’ve been writing about the legal profession, the line between plaintiff- and defense-side litigation was clear, stable, and widely respected. Small, scrappy firms took plaintiffs’ work on contingency; large, prestigious firms defended corporations for hourly rates. That division has been eroding—slowly at first, then with increasing speed. Today, defense-oriented Biglaw firms are actively seeking plaintiff-side engagements for their corporate clients, competing with the plaintiffs’ bar for cases that they wouldn’t have looked at even a decade ago. On Wednesday, May 6, I had the pleasure of moderating an excellent panel discussion dedicated to exploring these developments. It featured three great experts: Eva Cole , co-chair of the antitrust and competition practice at Winston Taylor; Evan Meyerson , managing director at Burford Capital; and Avi Weitzman , co-chair of the complex litigation and arbitration practice at Paul Hastings. I’m now pleased to share our conversation with you as a special episode of the Original Jurisdiction podcast. Thanks to the panelists for the time and insight, and thanks to Burford Capital for organizing this great event…
